OK, well maybe just the MP3 part is true, but the music industry has changed so dramatically since the introduction of MP3s that it's not even funny. Unlike CDs that replaced analogue tapes, MP3s are not just a new format to which you can listen to music, but also a means by which music can be distributed.
First off, no matter how you phrase or explain your use of MP3s you download, downloading songs that are available for sale is stealing and stealing is illegal. I won't think any worse of anyone who downloads music because I've done my share of downloading in the past, but not anymore. Now, I'll buy records. What I do miss, however, is how when I was younger I would save up my allowance so that I could buy an album.
The anticipation. It's kinda what you get when waiting in line to get into a concert. Nowadays that mentality has changed because if you can't afford it you can download it. Not a completely bad concept, but think of the long term effects. The music industry needs your dollar to survive and make more music. As a music fan I didn't see why I should be deprived of hearing good music. As a musician I feared what the impact of downloading would have on my career. How would my album get on the album charts if people downloaded my music instead of buying it?
How would my label, who's trying to make their money back from record sales, react come time to make a second album? Would they tell me that sales from my first album were so poor that there wouldn't be a second record?
As a promotional tool, MP3s are no doubt a god send. At first I was blown away at the ability to share my music and have some from as far as Hong Kong download and listen to my music. The difference between someone downloading the music I put up on my website and downloading the latest Pearl Jam single is the fact that it was I who made my music available.
If any of you get further into your careers as musicians you will soon find out that file sharing is the enemy. If you are a starting out musician trying to expose and promote your music, then file sharing is good. If you are a signed artist trying to sell records and tour, then file sharing is bad. Think about this A venue will book a band based on their popularity. How does one judge how popular a band is? Radio play and record sales.
Now not every band gets played on the radio so the next thing people look at are record sales. But guess what? If your songs are being downloaded then record sales drop. And with no record sales your band looks like they have no fans. What venue would book you if they think you have no fans to bring to the show?
See where I? Truth is, there are pros and cons, but how do you regulate everything? How can struggling, new bands use MP3s to break into the music scene and how can they survive once they've made it? What are your thoughts on the uses of MP3s and file sharing?

I think you're right that it's the regulation of the thing that poses the greatest problems. From my end of things, I try to promote myself through the MP3s by record a bunch of them -- really poorly.
I place the emphasis with those on the fact that I write a ton -- they're basically an audio blog of sorts. Those are free, but once the song gets recorded for real I wouldn't want to lose the money and time I've invested by giving it away.
In the meantime, I'm a small enough operation that I get booked in clubs and bars based on being a prolific songwriter and not so much as a reflection of sales. All the money I make as a musician is from playing live. A rise in popularity would make that an increasingly tenuous equation, though. The industry is changing.

My band has yet to record a full album yet, but my thought is to just stream the entire album and then sell it on the site. Granted, there are some folks that know how to rip the songs from the streaming tracks, but those computer geeks, like myself, are few and far between.
If they listen to the streaming tracks and dig them, then they will probably want to buy the album. Perhaps you can make the sound quality less than perfect when they are streamed too. This could be good and bad because if it doesn't sound good then the listeners may not want to buy the album. I think we all have a lot to learn in this somewhat new phase of the music industry.
I don't even think a label is absolutely necessary anymore to be successful. If you think about eliminating the middle man, you are going in the right direction. If you have faith in your music, then you know you will be able to sell albums. Without a middle man, you could make the same amount of money with album sells as an artist with a label that sells about or so.
If you know you will be cutting a lot of records, it would behoove you to invest in a good quality printer. You don't even have to pay the middle man for your CD inserts anymore. However you need to look at marketing yourself differently. Develop an email list and keep updating it, use your fans as marketing assets who better to promote you to someone than a fan who thinks you are fantastic!
Track return visits to your website and how many people add you to Favorites if possible, find out where the people are that add you to their Favorites list. Track how many people are downloading your music and again see if you can find out where they are located. Especially keep in mind that the business is changing quickly. Yeah, full lengths are still important, but singles are comin' back! The reason is simple.
How many times have you bought a CD especially with minutes of music on it and then programmed 3 songs out of 18 or 20 because they are the ones you like? The Beatles were masters of singles, selling a ton of them. They wrote great albums, as well, but not everyone has a great album in them. So you hear a song you like and you buy it for 99 cents! If you incorporate all these stats into your promotional efforts, you can market yourself very effectively.
Your email and paper mailing addresses merged and purged of duplicates tell you where your fan bases are. Your merchandise and CD sales,and downloads, whether sold or given away for free even free takes up space tell a story about how strong you are in markets you want to work in.
If you know where you have a strong base and where you need work, you can direct your efforts where they're most needed. This also impresses talent buyers when they see that you have a plan for success What is needed is the right technology to enable your fans to download the music they pay for in a "read only"type of format that they could play on their computer and maybe copy ONCE for boombox play. After that if you tried to burn copies, encrption would cause the copies to be so much noise.

Then sold some too. As time when on, we found that we can provide "plays" for free and sold more CD's When she cut her 3rd CD, we did less free downloads, allowed plays but charged for both downloads and CD's. By her 4th CD I started to "open" some songs for downloading for short periods of time depending on what folks were listening to and what we wanted to "introduce" them to or promote. Having the right songs on the "right" sites was one of the most important.
